The Problem with Scotland’s Legal System

Scotland. A nation that is known for its pride, honour and freedom is losing all three aspects due to its modern legal system.

Christopher Daniel

An 18 year old dental student from Glasgow, was found guilty of sexually assaulting a 6 year old girl over the course of two or more years after a 3 day trial
He was discharged after the hearing at Dumbarton Sheriff Court. The student won’t be put on the sex offenders register, and has no criminal record.

The young girls mother was refused the chance to read the Sheriff’s report on his decision.
According to the Independent:

“They believe too much emphasis was given to the student’s middle-class background, strong educational attainment and career prospects”

This student is not just a criminal, he is a pedophile and it is abhorrent that anyone would even consider discharging him let alone actually going through with it.
Due to the fact this young man has no criminal record, it means employers won’t see any problem with him in regards to safety straight away, which could mean he may end up working with children once again. This is unacceptable in the eyes of the victim’s family, and my own.

An appeal to this hearing was meant to occur to challenge the result of it. However in January, it was cancelled and the result went through.

The family has re-appealed in hopes of getting Christopher placed onto the Sex Offenders Register.
What happens if the appeal is rejected and it falls through, and this sexual predator is allowed to carry on with his life with no consequences, even after scarring the mind of the most innocent thing in life, a child.

How can we take pride in a country that allows this to happen?
I know for a fact the people of Scotland do not stand for this, but why do we allow the higher ups, the people who run this country to do this?

Have we became so complacent and docile, that we don’t even stand up for the youth of our nation anymore?

Mark Meechan

A Youtuber from Coatbridge under the name ‘Count Dankula’, was found guilty of hate speech for uploading a video of his pet pug doing a nazi salute and reacting to “Gas the jews?”.

After the hearing at Airdrie Sheriff Court on the 23rd of April 2018. He was punished under the ‘Communications Act 2003’. He was fined £800, he was given 6 months to pay the fine. Or face criminal prosecution.

By uploading a video titled “M8 yer dug’s a Naazi” that was intended to annoy his girlfriend by in his words “to turn her beloved animal, into one of the most horrible things he could think of”, a nazi, he committed a criminal offence.

He was arrested, because of a joke.

He was told that context of the joke didn’t matter, and has a permanent mark on his name for something that should’ve been a joke itself when it was brought up in the hall of Airdrie Sheriff Court. But instead, he is a criminal.

Mark has been under constant attack from hate mobs and reporters, he has had people show up to his door and others trying to ruin his livelihood. He is unemployable due to his non existent Alt Right connections.

Why is our legal system and police force targeting jokes and words?
Humour is a staple to Scotland, and now its being targeted by authorities
Hate speech laws are worrying in their own right due to the fact that it means words are criminalised, its something that’s impossible to set in stone and is merely something that causes more problems in itself, than solves.
Why do we have a law that changes depending on the person reading it?

Again, why are we not saying anything about this, regardless of our political views, why are we allowing our speech to be restricted in the name of law and order?

Where is our freedom, if we don’t even fight to keep it.

The Worrying Problem

When you compare these two cases, you’d think to yourself “Why?”

Why is a predator allowed to walk away free after doing unspeakable acts to a young girl?
Why is he allowed to continue his life with no real consequences?
Why is someone being punished for an offensive joke?

Why are words being viewed as more obscene than the molestation of a child?

Why does our system allow the abuse of a generation?

And most importantly, why are we, the people of Scotland allowing this to happen?

We must take a stand against these problems, as it goes to show the system isn’t, there must be change in the way it works.

Punishment must come to those who commit genuine crimes instead of having word police making us fearful of making jokes

We must talk about this.
It must change.
